Privacy policy on the processing of personal data

In accordance with Law no. 195/2024 on the protection of personal data of the Republic of Moldova. The aidreptate.md platform.

1. Who we are

JUSTICO S.R.L., a legal entity under Moldovan law, with its registered office at str. Chișinăului no. 21, Anenii Noi, Anenii Noi district, Republic of Moldova (IDNO: 1026023127042), hereinafter the "Platform"* or the "Operator", provides technical assistance services for drafting statements of claim, accessible through the website www.aidreptate.md.

This Privacy Policy explains what personal data we collect, for what purpose, on what legal basis, how long we keep it, and what rights you have in relation to it as a user of our services.

2. What personal data we collect

3. Special attention to the IDNP and the statement-of-facts content

The IDNP (Personal Numeric Identifier) is a unique national identifier of high sensitivity that allows the direct and unambiguous identification of a person across all state registers. Collecting the IDNP is MANDATORY, not optional: under the civil-procedure legislation of the Republic of Moldova, a statement of claim that does not contain a party's IDNP will not be accepted by the court. Without this identifier, the Platform cannot produce a procedurally valid document. We treat the IDNP with enhanced security measures (see section 8).

The statement-of-facts field is a free field, completed by you. If your situation incidentally involves information about health, private life, ethnic origin or other special categories of data (for example, in a dispute concerning medical malpractice, discrimination or family relations), this information is necessary solely to correctly draft the legal document. Please include in this field strictly what you consider necessary to correctly present your case. Only you are best placed to assess which facts and details are relevant to the situation you wish to present. The Platform does not verify, and does not require you to justify, the relevance of the information entered. The responsibility for assessing this rests with you.

The processing of any special categories of data, when they appear in the content you provide, is based on your explicit consent, expressed through the voluntary submission of the information in the statement-of-facts form, necessary for the establishment, exercise or defence of a legal right.

4. Purpose of processing

  • Drafting the statement of claim, according to the data and instructions you provide;
  • Communicating with you regarding the order placed (confirmations, clarifications, delivery of the final document);
  • Invoicing the services provided, in accordance with accounting and tax obligations;
  • Improving the operation of the site based on the technical data collected (see the Cookie Policy).

6. Who we share your data with

Your data is not shared with third parties for marketing purposes. Data may be shared strictly for the stated purpose, with:

  • The person designated by the Platform who drafts the requested document;
  • Technical providers (hosting, e-mail), as processors, under a data-processing agreement;
  • MAIB (B.C. «Moldova Agroindbank» S.A.), as payment processor, to process the data strictly necessary to carry out, confirm and record the payment of the ordered services; MAIB has no access to the case content or the statement of facts;
  • The accountant who maintains Justico SRL's financial and accounting records, for the purpose of issuing an invoice when you expressly request one (name/company name, IDNP/IDNO, address, contact details); the accountant has no access to the case content or the statement of facts;
  • Anthropic PBC, the provider of the artificial-intelligence technology used by the Platform for assisted document generation, as a processor, which processes the data and content you enter (including the statement of facts) solely for the purpose of drafting the requested document; this provider is located outside the Republic of Moldova and the European Union (see section 7 on international data transfer);
  • Public authorities, where required by law (for example, at the official request of a court or a supervisory body).

The final document (the statement of claim) is delivered to you; the actual filing with the court and any subsequent steps always remain your responsibility. The Platform provides technical drafting assistance only and does not file documents on your behalf.

7. International data transfer

If the Platform uses hosting providers or other technical services located outside the Republic of Moldova/European Union, the transfer of data takes place only to providers that offer adequate safeguards (for example, standard contractual clauses), in accordance with Law no. 195/2024.

8. Security measures

  • Access to your data strictly limited to the personnel directly involved in processing the request;
  • Transmission of data over encrypted channels (HTTPS);
  • Secure storage, with enhanced protection measures for the IDNP and any special categories of data;
  • Internal procedures for reporting and managing security incidents.

10. Your rights

As a data subject, you have the following rights under Law no. 195/2024 (Art. 13-22):

  • The right of access to your data;
  • The right to rectification of inaccurate data;
  • The right to erasure of data ("the right to be forgotten"), except where retention is required by a legal obligation (for example, archiving documents of legal or tax relevance);
  • The right to restriction of processing;
  • The right to data portability;
  • The right to object;
  • The right to withdraw your consent at any time for processing based on consent, without affecting the lawfulness of processing carried out before withdrawal;
  • The right to lodge a complaint with the National Centre for Personal Data Protection (CNPDCP).

10.1. The right to erasure (the "right to be forgotten")

You may request the erasure of your data at any time by contacting us at the details given in section 12. Data is removed from active systems within no more than 30 calendar days of your request being received. Backups, kept to protect data against loss, are erased in the course of their scheduled rotation, within no more than 90 days.

10.2. Exceptions to the right to erasure

Erasure cannot be carried out where:

  • retention is required by a legal obligation (for example, the obligation to archive documents of legal relevance under the procedural and accounting legislation of the Republic of Moldova);
  • the data is necessary for establishing, exercising or defending a legal claim (including documents relating to a pending or foreseeable case);
  • processing is necessary for compliance with a legal obligation, for the protection of public interests, or for the exercise of official authority.

10.3. How to request erasure

To request erasure, send a written request to contact@aidreptate.md or to: str. Chișinăului no. 21, Anenii Noi, Anenii Noi district, Republic of Moldova.

Please state in your request:

  • your identification data (surname, first name, IDNP);
  • a precise description of the data you want erased;
  • a means of contact (e-mail or telephone) at which we can confirm the erasure.

11. Changes to this policy

This policy may be updated periodically to reflect legislative changes or changes to the services offered. The date of the last update is indicated on the first page. We recommend that you consult this page periodically.
