Before filing a claim, ask yourself whether a direct agreement might be the better solution. The answer depends on a few concrete factors.
The advantages of an amicable settlement
- You save time — even the small-value procedure can take up to 6 months.
- You reduce legal risk — no claim has a guaranteed outcome.
- You preserve the relationship with the other party — supplier, neighbour, business partner.
- You avoid extra costs — travel, time off work, preparing the file.
When a settlement is the better choice
- The amount offered is close to your claim.
- Time matters more than the exact amount.
- The sum at stake is relatively small.
- The evidence you have is insufficient or hard to present in court.
When it is worth going to court
- The amount offered is well below the actual loss suffered.
- You consider it important to establish a principle, not just recover a sum.
- You have solid evidence that is hard to contest.
- The loss is significant in value.
A useful procedural detail
Moldovan law actively encourages the amicable resolution of disputes: the parties may reach a settlement at any moment in the process, and the court can confirm it by an order that carries the same force as a court judgment and is directly enforceable — without any need to continue the proceedings.
