Illustrative situations where a small-value claim made a difference

The examples below are hypothetical, built to illustrate the kind of situations a small-value claim or an ordinary civil action can resolve. They are not real court judgments and do not constitute precedent.

A significantly delayed flight

A passenger whose flight was delayed by more than three hours at the final destination claimed from the airline the compensation provided for by passenger-rights rules. The company's initial refusal was followed by a formal claim, supported by the travel ticket and proof of the delay.

Incorrect billing by a service provider

A customer, comparing the invoices with the signed contract, noticed that an internet provider was charging more than the agreed amount. A written complaint, followed by a small-value claim supported by the contract and invoices, led to the amount being corrected.

Repeated unsolicited commercial messages

A person who constantly received advertising messages from the same sender, despite having asked in writing for them to stop, documented each message and notified the competent authority, obtaining an end to the practice.

Cancelling a transaction with unfair terms

A buyer who wished to cancel a furniture order within the 14-day legal period ran into a contractual clause imposing an unjustified penalty. Invoking the legal right of withdrawal led to a full refund.

What these situations have in common

  • Rigorous documentation — contracts, invoices, screenshots — was decisive in every case.
  • The claim was clearly formulated, with a precise legal basis.
  • The right instrument — a small-value claim, a complaint to an authority, or an ordinary claim — was chosen according to the type of harm.
