A few situations where it is worth going to court and the applicable Moldovan law

The procedure is simple, but not every grievance reaches, or should reach, the court. Here are a few common situations and the Moldovan legal basis behind each.

Defective products and services

You bought a product that turned out to be defective and the shop refuses a refund, or you paid for a service that was performed inadequately.

Basis: Law no. 105/2003 on consumer protection, read together with the Civil Code provisions on consumer contracts and the guarantee for defective products.

Is it worth suing? Yes, if you have evidence — a receipt, contract, correspondence — and the loss can be quantified.

Delayed or cancelled flights, non-conforming holiday packages

For flights falling under the passenger-protection rules also applied in Moldova — aligned with Regulation (EC) no. 261/2004 through the rules of the Civil Aviation Authority — you can claim compensation or refunds in the event of significant delay, cancellation or denied boarding.

For holiday packages that do not match what was promised, the liability of the agency or operator arises from the contract for the provision of tourism services and from the general rules of the Civil Code on contractual liability.

Worth it? Yes — first check the carrier's or agency's compensation policy, then formulate the claim.

Breach of a contract

A contractor who abandons the work halfway; an owner who refuses to remedy previously agreed defects.

Basis: the Civil Code — the chapter on obligations and contracts, the section on contractual liability.

Worth it? Yes, especially with a written contract detailing each party's obligations.

Damage to private property

A neighbour who floods your flat through a neglected leak; a car damaged by the works of an adjacent building site.

Basis: the Civil Code — tort liability, for compensation of the harm caused by an unlawful act.

Worth it? Yes, with solid evidence — photographs, a repair estimate, witness statements.

Incorrect billing or unjustified charges

An internet provider charging more than agreed; a subscription you asked to cancel, yet the charge keeps appearing.

Basis: the contract concluded, read together with Law 105/2003.

Worth it? Yes, if you can compare, with documents, the agreed amount against the amount actually billed.
